How to open a safe deposit box after death in Ohio

On Behalf of | Oct 19, 2026 | Estate Planning |

Many people keep their will or other important documents in a safe deposit box. Unfortunately, this creates significant legal hurdles for the family members or heirs seeking to access it after the testator dies. If you are looking for a way to open your loved one’s safe deposit box, here is what you need to know.

Retrieving the will

Many Ohio banks restrict access to a safe deposit box following a customer’s death. If you are going to access it, you must file a petition to the local probate court for an order allowing supervised examination of the safe deposit box to look for the will. Usually, a bank employee supervises this initial opening so that you only remove the will. You must leave all other valuable items inside the vault until the court officially appoints an estate representative. However, if you were a co-renter of the safe deposit box when the testator was alive, you may gain access to its contents. However, access does not usually mean ownership.

Retrieving other contents in the safe deposit box

Releasing the remaining contents of the box requires official legal authorization from the county probate court. The judge grants letters of authority to an executor or administrator to manage estate assets. Through orderly estate administration, the appointed representative takes custody of the assets to safeguard them for designated beneficiaries.

Honoring your loved one’s final wishes

Handling an estate properly honors your loved one’s legacy and helps ensure their final wishes are carried out as intended. When you follow these clear legal steps, you protect family harmony and carry out the deceased person’s true intentions. If you feel unsure at any point, an estate planning attorney can guide you through the process and help you navigate the local court system with confidence.
